Rose NeuroSpa (“Rose NeuroSpa,” “we,” “us,” or “our”) is committed to protecting the privacy and confidentiality of your health information. We may use or disclose information when permitted or required by law for purposes such as public health and safety activities, reporting abuse or neglect, health oversight activities, workers’ compensation, certain law-enforcement activities, judicial or administrative proceedings, and preventing or reducing a serious threat to health or safety.
Additional legal protections may apply to certain behavioral-health information, psychotherapy notes, substance use disorder records, and other specially protected information.
Uses and Disclosures Requiring Authorization
We will obtain your written authorization when required by law, including for most uses and disclosures of separately maintained psychotherapy notes, certain marketing activities, the sale of PHI, and other uses or disclosures for which authorization is required.
If you provide an authorization, you generally may revoke it in writing at any time, except to the extent we have already acted in reliance on it.
Substance Use Disorder Records
Information concerning substance use is not automatically subject to the federal confidentiality requirements of 42 C.F.R. Part 2.
If Rose NeuroSpa receives or maintains substance use disorder patient records protected by 42 C.F.R. Part 2, we will protect those records as required by applicable law.
Part 2-protected records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient except as specifically permitted by law, including pursuant to appropriate patient consent or a qualifying court order and subpoena.
Your Privacy Rights
Subject to applicable law, you have the right to:
- Access your records. You may request to inspect or obtain an electronic or paper copy of your health information.
- Request corrections. You may ask us to correct information that you believe is inaccurate or incomplete.
- Request confidential communications. You may ask us to communicate with you in a particular manner or at a particular location.
- Request restrictions. You may ask us to limit certain uses or disclosures of your information. We are not required to agree to every request. When required by law, we will honor a request not to disclose information to a health plan concerning a service you paid for in full out of pocket.
- Request an accounting of disclosures. You may request a list of certain disclosures of your health information as provided by law.
- Receive a copy of this Notice. You may request a paper copy of this Notice at any time, even if you received it electronically.
- Choose a personal representative. A person legally authorized to act for you may exercise your privacy rights as permitted by law.
- File a complaint. You may complain if you believe your privacy or confidentiality rights have been violated.
Our Responsibilities
Rose NeuroSpa is required by law to:
- maintain the privacy and security of your PHI;
- provide you with notice of our legal duties and privacy practices;
- follow the Notice of Privacy Practices currently in effect;
- notify you following a breach of unsecured PHI when notification is required by law; and
- comply with applicable additional protections for specially protected health information.
We will not use or disclose your health information in a manner requiring your authorization unless you provide that authorization or another provision of law permits or requires the use or disclosure.
Changes to This Notice
We may change this Notice and our privacy practices as permitted by law. Changes may apply to information we already maintain as well as information we receive in the future.
